Terms of Sale — Car Rental
This agreement sets out the relationship between a customer requesting a
rental vehicle through the Antalion platform and the independent rental
company providing the vehicle. (Template text — the final legal text should not be published before review by qualified counsel.)
1. Parties and the Role of the Platform
Antalion is a marketplace/software platform, not a rental company. The
rental contract is formed directly between the customer and the rental
company whose quote the customer accepts. The vehicle, its condition,
insurance cover and roadworthiness are the responsibility of that
company.
2. Quotes and What the Price Includes
Rental companies respond to a request with a structured quote for a
specific vehicle. The quote states the rental total, the daily mileage
allowance, the excess-mileage charge, the insurance package, the security
deposit and any delivery/collection fee as separate line items. Amounts
are shown in euro (EUR). Optional extras selected by the customer are
added to the total before payment.
3. Prepayment and Balance
When the customer accepts a quote, a prepayment is collected online
through Antalion's payment infrastructure (iyzico). The prepayment is
part of the rental price, not an additional charge; the remaining balance
is paid directly to the rental company when the vehicle is collected. The
prepayment can never exceed the rental total. If the customer does not
collect the vehicle and has not cancelled within the period in Section 6,
the prepayment is not refunded.
4. Security Deposit
The security deposit is collected by the rental company at handover, not
by Antalion, and is not part of the rental price. It is returned by the
company after the vehicle is returned undamaged, with fuel and mileage
terms met. Any deduction is a matter between the customer and the rental
company; Antalion may assist in resolving the dispute but does not hold
the deposit.
5. Driver Requirements
The customer confirms that the driver meets the minimum age and minimum
licence-held period stated in the accepted quote, holds a valid driving
licence recognised in Türkiye, and — where the company requires it — a
credit card in the driver's own name for the deposit. The vehicle may
only be driven by drivers declared to and approved by the rental company.
6. Cancellation and Changes
The customer may cancel free of charge up to 48 hours or more before the
collection time; the prepayment is then refunded in full. Cancellations
made less than 48 hours before collection are not eligible for a refund.
Changes to the collection or return time, place, or to the vehicle itself
require the rental company's approval and may change the price.
7. Use of the Vehicle
The vehicle must be used in accordance with traffic law and the rental
company's rules stated in the quote — including any restriction on
leaving the country, off-road use, subletting, or towing. Traffic fines,
bridge/motorway tolls and fuel are the customer's responsibility. Damage
outside the insurance cover stated in the quote is charged by the rental
company.
8. Delivery and Return
The vehicle is delivered and returned at the points and times stated in
the accepted quote. If the customer selected a different return location,
the one-way fee shown in the quote applies. Late return may be charged as
an additional rental day by the company.
9. Distance-Contract / Right-of-Withdrawal Exception
Vehicle rental services to be provided on a specific date or within a
specific period are among the recognised exceptions to statutory rights
of withdrawal for distance contracts; cancellation and refund rights are
governed solely by Section 6 above.
Intellectual Property
The Antalion brand, logo, website and platform software belong to
Antalion; they may not be copied, reproduced or used for commercial
purposes without prior written permission.
Limitation of Liability
Antalion's liability arising from this agreement is limited to the
commission amount collected for the booking in question. Antalion is not
liable for the actual performance of the service, for indirect damages,
loss of profit, or for failure to achieve an expected saving.
Force Majeure
Neither party is liable for failure to perform its obligations due to
circumstances beyond its reasonable control, such as natural disaster,
epidemic, war, act of terrorism, strike, or decisions of public
authorities; in such cases the booking may be cancelled by mutual
agreement and any payment made is refunded.
Governing Law and Dispute Resolution
This agreement is governed by the laws of the Republic of Türkiye; the
courts and enforcement offices of Antalya, Türkiye have jurisdiction over
any dispute. Consumers resident in the European Union may, if they wish,
also use the European Commission's Online Dispute Resolution platform
(ec.europa.eu/consumers/odr).
Severability
If any provision of this agreement is held invalid, that does not affect
the validity of the remaining provisions.
