Terms of Sale — Helicopter Transfer & Scenic Flights
This agreement sets out the relationship between a customer enquiring
about a helicopter transfer or scenic flight through the Antalion
platform and the licensed air operator providing the flight. (Template text — the final legal text should not be published before review by qualified counsel.)
1. No Online Sale — Enquiry Only
Helicopter transfers and scenic flights are not sold online on this
platform. Submitting the form on the relevant page is an ENQUIRY, not a
booking and not a payment: it creates no contract and reserves no
aircraft. Our team responds with availability and a price, and any
booking is then concluded separately, in writing, on the terms given at
that point.
2. Parties and the Role of the Platform
Antalion is a marketplace/software platform and is not an air operator.
Any flight is performed by a licensed air operator holding the required
operating certificate, aircraft airworthiness documentation and
insurance; the flight contract is formed between the customer and that
operator.
3. Price, Availability and Confirmation
Prices quoted in response to an enquiry are valid only for the aircraft,
route, date and passenger count stated, and only for the period stated in
the quote. A flight is confirmed only when the operator confirms it in
writing.
4. Weather, Airspace and Authority Decisions
Flights depend on weather, visibility, airspace availability and the
decisions of aviation authorities. The pilot in command has final
authority on whether a flight may safely depart or continue. If a
confirmed flight cannot take place for these reasons, the customer is
offered an alternative slot or a full refund of any amount paid.
5. Passenger Requirements
Passenger weights, ages and any mobility or health condition must be
declared accurately in advance, because they affect aircraft loading and
safety. The operator may refuse carriage where a declaration proves
inaccurate or where safety requires it. Baggage allowances are set by the
operator and are strictly limited.
6. Cancellation
Cancellation terms for a confirmed flight are those stated in the
operator's written confirmation, because aircraft and crew are reserved
specifically for the customer. Where no term is stated, the platform's
general rule applies: free cancellation up to 48 hours or more before
departure, no refund inside that period.
7. Distance-Contract / Right-of-Withdrawal Exception
Passenger transport and leisure services to be provided on a specific
date are among the recognised exceptions to statutory rights of
withdrawal for distance contracts.
Intellectual Property
The Antalion brand, logo, website and platform software belong to
Antalion; they may not be copied, reproduced or used for commercial
purposes without prior written permission.
Limitation of Liability
Antalion's liability arising from this agreement is limited to the
commission amount collected for the booking in question. Antalion is not
liable for the actual performance of the service, for indirect damages,
loss of profit, or for failure to achieve an expected saving.
Force Majeure
Neither party is liable for failure to perform its obligations due to
circumstances beyond its reasonable control, such as natural disaster,
epidemic, war, act of terrorism, strike, or decisions of public
authorities; in such cases the booking may be cancelled by mutual
agreement and any payment made is refunded.
Governing Law and Dispute Resolution
This agreement is governed by the laws of the Republic of Türkiye; the
courts and enforcement offices of Antalya, Türkiye have jurisdiction over
any dispute. Consumers resident in the European Union may, if they wish,
also use the European Commission's Online Dispute Resolution platform
(ec.europa.eu/consumers/odr).
Severability
If any provision of this agreement is held invalid, that does not affect
the validity of the remaining provisions.
